These Terms and Conditions (also referred to as our "Terms of Service" or "Terms") govern your access to and use of moshamericas.com (the "Site"), our design and development services (the "Services"), and any communications you receive from Mosh Americas LLC ("Mosh Americas", "we", "us"), including SMS / text messages. By using the Site or opting in to our communications, you agree to these Terms and Conditions.

1. Eligibility

You must be at least 16 years old and have the legal capacity to enter into a binding agreement to use our Site and Services.

2. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You will not:

Use the Site in any way that violates any applicable law or regulation.
Attempt to gain unauthorized access to any portion of the Site, server, database, or related systems.
Use any automated means (bots, scrapers) to access the Site without our prior written consent.
Engage in any activity that interferes with or disrupts the Site.

3. Intellectual Property

All content on the Site — including logos, text, images, video, code, and design — is owned by Mosh Americas or licensed to us, and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission. Case studies featured on the site remain the intellectual property of the respective brand owners and are displayed with permission as portfolio work.

4. Services and Engagements

Specific terms governing our paid Services (scope, deliverables, payment, ownership, revisions) are set out in individual project agreements or statements of work signed between Mosh Americas and the client. These Terms do not replace those agreements.

5. SMS / Text Messaging Terms

By providing your mobile number and opting in, you consent to receive SMS / text messages from Mosh Americas as described below. Consent is not a condition of purchase.

a. Program description

Mosh Americas operates a non-recurring transactional and marketing SMS program for customers and prospects who have explicitly opted in. Messages may include appointment confirmations, project updates, invoice reminders, service offers, and event invitations.

b. Opt-in

You can opt in by:

Submitting a form on our website where SMS consent is clearly disclosed.
Replying START or YES to one of our outbound numbers.
Providing explicit verbal or written consent during a sales / onboarding interaction.

c. Message frequency

Up to 5 marketing messages per month, plus additional transactional messages tied to active services.

d. Costs

Message and data rates may apply. We do not charge for SMS, but your carrier may apply standard messaging charges. Contact your carrier for plan details.

e. Opt-out

Reply STOP to any message at any time to unsubscribe. You will receive a one-time confirmation. To resubscribe later, reply START.

g. Carrier disclaimer

Carriers (AT&T, T-Mobile, Verizon, US Cellular, Sprint, MetroPCS, Boost, Cricket, Virgin Mobile, and others) are not liable for delayed or undelivered messages. Service availability depends on carrier capabilities.

h. Privacy

Your mobile number and SMS opt-in data are handled in accordance with our Privacy Policy. We do not share, sell, or rent mobile information to third parties for marketing or promotional purposes.

6. Disclaimers

The Site and Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee the Site will be uninterrupted, error-free, or secure.

7. Limitation of Liability

To the maximum extent permitted by law, Mosh Americas shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, Services, or SMS communications.

8. Indemnification

You agree to indemnify and hold Mosh Americas harmless from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Site or Services.

9. Governing Law

These Terms are governed by the laws of the jurisdiction where Mosh Americas is registered, without regard to conflict-of-law principles.
